A ação contra a TelexFREE foi iniciada pelo Governo do Estado do Acre, através do Procon-AC (demandante da ação), órgão criado através da Lei Estadual nº. 1.341, diretamente ligado a Secretaria de Estado de Justiça e Direitos Humanos, ou seja, sob o comando e responsabilidade administrativa do governador Tião Viana (PT), conforme pode ser conferido AQUI. O Procon-AC é gerenciado pela esposa do vice-governador do Acre, César Messias.
O Ministério Público do Estado do Acre (MP/AC), também entidade diretamente vinculada ao governo do Acre, recebeu a demanda do Procon/AC e moveu ação contra empresa.
A juíza Thaís Borges, da 2ª Vara Cível da Comarca de Rio Branco, julgou favorável a medida proposta pelo MP/AC para suspender as atividades da TelexFREE.
Guerra Jurídica
Bloqueada desde 18 de junho, o caso pode ainda não ter um desfecho no Acre. De todo modo, o julgamento do mérito do Agravo de Instrumento que será realizado hoje é o recurso pelo qual empresa e Divulgadores aguardam ansiosos, pois decidirá, finalmente, acerca do mérito da questão, quando os desembargadores poderão definir pela manutenção, ou não, da liminar que impede a TelexFREE de retomar suas atividades.
A batalha jurídica já é considerada uma das mais complexas e impactantes da história do judiciário acreano. Nove recursos foram interpostos pelos advogados da Empresa como parte integrante do arsenal jurídico na tentativa de acelerar a decisão da justiça sobre o caso, mas todos sumariamente indeferidos pelo TJAC.
Indícios e conspirações
O processo que paralisou as atividades da TelexFREE é pautado em indícios e especulações sobre atos conspiratórios contra empresa, agenciados por concorrentes e grupos políticos.
Fontes do Acrealerta chegaram a revelar que o problema pode não ter solução definitiva no Acre, uma vez que o responsável pela autoria (Procon e MP/AC) do processo e pelo julgamento da ação (TJAC) não encontram uma alternativa viável, pois a queda da liminar garantiria, quase que automaticamente, uma indenização sem precedentes contra o governo do Acre.
“Sinuca de Bico”
O impasse apresenta uma equação complexa e praticamente impossível de ser solucionada na justiça acreana, onde o governo petista tem absoluta interferência.
De um lado, divulgadores (eleitores) acreanos literalmente indignados com a arbitrariedade da decisão que criou caos e prejuízos incalculáveis a centenas de milhares de famílias que podem facilmente decidir uma eleição no Acre, especialmente considerando a pífia diferença de votos nas duas últimas eleições majoritárias ocorridas no Acre, onde o atual governo por pouco não foi substituído.
De outro, caso a decisão seja favorável à empresa, um problema que atingiria diretamente o Governo e diversos atores envolvidos no processo. Grupos organizados através das mídias sociais já mobilizam uma ação coletiva contra o Governo do Acre bem como planejam uma avalanche de ações individuais, por perdas e danos, a outros atores diretamente envolvidos no caso. A queda da liminar levantaria precedente jurídico para uma indenização praticamente certa contra o governo do Acre.
Com a barriga
O julgamento do Agravo de Instrumento que será realizado hoje foi adiado por várias vezes. Segundo fontes do Acrealerta.com, tais adiamentos fariam parte da estratégia da acusação: paralisar as atividades da empresa pelo máximo período de tempo, o que poderia comprovar a prática de “pirâmide financeira” uma vez que sem a injeção de recursos oriundos do ingresso de novos divulgadores, a empresa poderia entrar em falência.
O Agravo de Instrumento será julgado pelos desembargadores Samuel Evangelista, Eva Evangelista e Waldirene Cordeiro.
Julgamento Encerrado
A batalha jurídica protagonizada pelo governo de Tião Viana (PT), que resultou na expedição de uma liminar pela justiça acreana paralisando todas as atividades da TelexFREE deve agora ser travada no âmbito da justiça federal.
Por unanimidade, a Câmara Cível do Tribunal de Justiça do Acre (TJAC), que teve como relator do processo o desembargador Samoel Evangelista, manteve os efeitos da liminar impedindo a retomada das atividades da empresa e dos milhões de divulgadores em todo país.
